selling a boat in France

    Thanks for the input. The boat was in France on the night of Brexit so that's ok. I have the original VAT exemption certificate from when she was built so I would have thought I'd be covered. Unless I'm missing something.

    My understanding is that if the boat was in the EU (ie France or Poland etc) on the night that Brexit happened then the boat is "Union Goods", you can sell it anywhere in the EU and it's nobody's business but your own. My only concern is that you are being paid directly into a UK bank account in Sterling which the UK authorities might see as a VAT issue, as of you're selling in the UK a boat  which happens to be in the EU. Would be safer to get paid in euros in France.

    I suspect you're right, but it's proving remarkably difficult to get a definitive answer here in France. The authorities like to get their fingers into every aspect of your life if they can, especially if they can charge a fee or a tax.

    Bonjour

    As far as I know France should not be concerned in the selling process as you sell a Polish boat. The Polish regulation should apply.

    If you have a "passeport" because the boat is in France, it should be transfered to the new owner once the owner's name has been changed.

    Hi, I suspect no one can answer this, but I thought I'd give it a go anyway. I have found a buyer for my yacht Alianco, which I advertised here.

    I am a British citizen with residency in France where she is sitting in a boatyard.

    I couldn't continue on the SSR which runs out in April since I don't live there anymore so I have registered her in Poland.

    The buyer is an American who is selling up and coming to live aboard in the med and further afield.

    He is paying me in sterling directly into my UK account. 

    We have put together an inventory including all known problems and making it clear the buyer will be fully responsible for ascertaining the condition and suitability of everything that comes with the sale. We will both sign this (mostly for my benefit).

    After he has bought it we will change the Polish registration over to him.

    My question is, what legal paperwork do I need to sell her and in whose jurisdiction?

    Can anyone point me in the right direction? Thanks
